TERMS OF USE

1. Ownership

1.1 The website thebox.travel, including logos, trademarks, copyrights, and services available on it, is owned by JPBT, Lda, a company headquartered at Rua Espinho Flor, 91, 2785-510 Cascais, registered at the Commercial Registry Office of Lisbon under registration number and corporate entity 514 992 964, with a share capital of 10,005 euros, and registration number 7966, hereinafter referred to as THE BOX.

1.2 THE BOX's business code is 79110 – Travel agency activities.

1.3 These Terms of Use aim to establish the terms and conditions governing access to information and content provided on the thebox.travel website and to handle bookings and payments for end clients, hereinafter referred to as "USER(S)."

1.4 THE BOX reserves the right to insert, modify, and remove, at its sole discretion and without prior notice, any information within these Terms of Use. The user is responsible for reviewing the content of the Terms of Use whenever consulting or booking travel through thebox.travel. Use of thebox.travel following any changes made by THE BOX will be considered as implicit acceptance of those changes.

2. Access to the Website

2.5 Notwithstanding the above, the parties agree to observe all legislation and regulations applicable to this website and to the bookings contracted through it.

3. Property Rights and Other Intellectual Property Rights

3.1 The thebox.travel website is for the user's personal and non-commercial use, limited to the purposes set forth in clauses 1.3, 2.1, and 5.5 of these Terms of Use. Any reproduction, transmission, display, publication, distribution, public availability, creation of derivative works, modification, adaptation, translation, transfer, or sale of any information, products, or services obtained through this site and any other forms of exploitation, in whole or in part, of the content and materials of the thebox.travel website, including text, images, software, audio, or video clips, must respect the intellectual property rights of THE BOX, protected by Portuguese and international copyright law, and is strictly prohibited without prior written authorization from THE BOX.

3.2 The use, acquisition, or storage of content, materials, functions, and information provided on the thebox.travel website may only be carried out through the means provided on the site. Specifically, the partial removal of text and/or images and reproduction in another context or partial or total reproduction of the thebox.travel website on another site are prohibited without prior written consent from THE BOX.

3.3 THE BOX's invoicing system is certified with the number 1455/AT.

3.4 USERS acknowledge and expressly accept that the contents, elements, and intellectual property rights (including, without limitation, copyright and related rights, copyright, patent, product or service trademark, and trade secrets) related to the THE BOX website and to which USERS access or receive are the exclusive property of THE BOX or its suppliers.

4.2 Reproduction, transfer, distribution, or storage of part or all content in any form, without prior written authorization, is prohibited, except as permitted by the following terms: (I) THE BOX allows the USER to view its pages on a computer or print copies of excerpts solely for personal use and not for redistribution, unless authorized in writing by THE BOX. (II) THE BOX allows the USER to access or use certain documents on its World Wide Web pages subject to additional terms specified in those documents, provided the USER expressly agrees to those additional terms.

4.3 USERS acknowledge and accept:

That, except as agreed herein, they acquire no additional rights to the content.
That the content, directly or indirectly received or accessed, is the exclusive property of THE BOX or its suppliers, who will continue to be its sole owners.

5. Changes to the thebox.travel Website

5.1 THE BOX may implement improvements or changes to the information, elements, data, services, and other elements of this website or cancel it at any time without prior notice.

5.2 THE BOX may also modify these Terms of Use of the site at any time, and such modification will be valid once posted on the website.

5.3 Therefore, access and subsequent use of the website imply USERS’ acceptance of the new Terms of Use.

5.4 THE BOX may suspend access to the system covered by this program due to maintenance work, network security reasons, or force majeure without prior notice.

5.5 This website is exclusively for public access to make reservations. We do not accept bookings made through travel agencies or other intermediaries acting on behalf of individuals or entities.

6. Liability

6.1 Without prejudice to the general conditions for selling services/products available on this site as set out in the General Conditions, and to the extent permitted by law, THE BOX does not provide any kind of warranties, whether express or implied, including, but not limited to, property warranties, non-infringement, implied warranties of merchantability, or fitness for any specific purpose, regarding the availability, accuracy, reliability, or content of these pages.

6.2 To the extent permitted by law, under no circumstances shall THE BOX be liable for any damages, including lost profits or direct or indirect damages related to the use, or inability to use the content, materials, functions, and information made available through the thebox.travel site, even if THE BOX has been advised of the possibility of such damages.

6.3 The above liability limitation includes damages to USERS' computers resulting from the direct or indirect, incidental, or consequential use of the thebox.travel website, as well as potential damages caused by the spread of viruses, "trojans," and "worms," regardless of their origin or mode of transmission.

6.7 USERS are responsible, in any case, for the accuracy of the data provided, and THE BOX reserves the right to exclude from registered services any USER who has provided false data, without prejudice to other actions that may be brought to judicial avenues.

6.8 USERS, when sending materials to any of THE BOX's servers via email or through THE BOX's website pages, agree to the following: (i) the materials shall contain nothing illegal or inappropriate for publication; (ii) they shall search for and eliminate any viruses or other destructive elements before submitting any material; (iii) they own the material sent or have an unlimited right to provide it; (iv) THE BOX may publish these materials without charges and/or incorporate the same or any concepts described therein in its products.

7. Applicable Law Portuguese law shall apply to all disputes arising from the interpretation or execution of these Terms of Use.
